Dutch rental law highly values the possibilty to renovate commercial and residential property.
Since 2003 the lessor has a strong legal position in these matters because the law prescribes that the lessee has an obligation to tolerate renovations. In 2011 this has led to resistance in political circles who plead for more lessee protection in matters of extensive renovation which can lead to early lease contract termination or temporary eviction. There is a possibilty that the position of lessees in case of renovation of the property may be improved by law in the near future. Lessors are challenged to look for other options.
